Legal Question in Family Law in Kansas

Almoney issue

I was given the choice of almoney, or a portion of my husbands KEEPERS at my divorce.

I choise KEEPERS, but the judge decided he felt I needed the almony more, due to my low income at the time.

I was awarded almony for 10 years (120 months), which was the amount compariable to the amount of KEEPERS I would have recieved at retirement.

I have been recieving it for 4 years now, (divorce final in Sept. 23, 2002).

Recently found out my ex-spouse has bloodclot in his lung, and may not survive.

He has an insurance policy of over $150,000 through his work place.

Since I was given the almony in LU of the KEEPERS, would I be able to recieve payment from his estate, if he does passaway, of the amount still owed to me for the remander of the almoney?

Sorry to sound like a ghoul,

but was married for 19 years and I am 50 yrs old..

So retirement is something I must think about.

And the remainder of the money (almoney) would go to a retirement fund for me.

Also if the answer is yes,

I CAN get a estate settlement againt what is owed me.

How do I go about it, if he dies?

THANK YOU

Re: Almoney issue

It really depends on the final order language used by the judge.
