Amending Child Custody Agreement

My exhusband and I have joint custody and neither one of us pay support to the other. He recently contacted me and wants me to keep our Three year old daughter Monday-Friday which would require me to put her in daycare. He doesn't want to pay child support other than me receiving the social security check she gets through him. He wants it to be temporary until he can find a steady job. I don't feel like she is well taken care of in his home and I would like to get full custody and receive some sort of support from him should she stop receiving the social security checks. How do i go about doing this? I'm struggling with debt and i'm not sure i can afford to pay a huge retainer fee. Is there somwhere i can go through the State for help?

You have an interesting situation. It is really too complex to fully address in this forum, but it is common for a court to substitute Social Security benefits for child support if a parent is disabled. New child support Guidelines came into effect on January 1, 2008, and they may affect your situation if shared residency is involved. If you incur daycare expenses, that will also affect the child support calculation. Consult an experienced family law attorney.
