My babys mother took the baby out of state without letting me know anything about it she has also blocked my from sending her any messages and she told me that shes not going to let me have any communication with the baby until she starts asking about her father the last message I got from her was see u in a couple years. Do I have a case?

It sounds like you have a case for visitation, and maybe custody. If you have been paying for the child's material needs, it strengthens your claim. If not, then you will need to establish paternity and paying support (or get an Order for the mother to start paying support to you.)

There are certainly rules in Kansas regarding the notice required to be given before moving a child out of state, but those rules are unclear as to whether they apply to a man who has never been married to the mother, and who has not been adjudicated to be the father of the child. The court will also look at how long the child has been out of state, so do not delay in pursuing legal action. If you seek a paternity Order and a Parenting Plan, your parental rights will be preserved. Child support will likely be ordered to be paid by the non-custodial parent.
