Birth certificate

My son got a married woman pregant. she is still married and plans to stay that way. even though she is still married can she legally give my sons last name to the baby?

The name of a child's actual father can always be listed on a birth certificate. If the father's name is left blank, Kansas law provides some presumptions about paternity which may cause problems if the natural father wants rights to the child in the future. Consult an experienced family law attorney.
