Legal Question in Family Law in Kansas
My brother is going thru a VERY NASTY divorce, the problem is his soon to be x-wife is harassing our family along with him. My mother has a P.F.S. order in effect for the next year. My brother is on bond, with a no contact order in tact. The problem is the soon to be x-wife keeps showing up at every turn, texting my phone and anyone else she can get ahold of!! We call the police at the least 2x a week. The police are now to the point that they look at us as the party that is breaking the law, they tell us there is nothing they can do unless they catch her in the act. He went to jail cuz she said he drove by the house that they lived in and yelled at her. She has made up all kinds of false accusations against him, somehow he gets charged every time. His weekly visitation of 3 hrs a wk was last nite, she shows up at activities on his visit time and then shows up on the front porch where he lives, he calls 911 to report it(as the police advise him too) then they tell him "well what do you want us to do about it?" Took them 35 to 40 min to respond, then dismissed it as if it was ok. The police tell him to file a P.F.S to make it stop. My brother went to the court house to file such papers and the judge DENIED it!! Is this right or proper?? WE NEED HELP BIG TIME, the story is bigger than just this, but i figured i would start with the most recent.
1 Answer from Attorneys
These are very fact-dependent matters. You need to consult directly with an attorney in your area. Your brother needs to bring up these issues with his attorney. If the wife is harassing him and interfering wtih visitation, the judge in that case will want to know.
Good luck
