hello! my question is this i have a soon to be 15 year old grand daughter that recently went to visit her father. she deceied to stay for a while but is ready to come back to me. now he says she has a choice him or her mother.her and her brother have lived with me off and on all theyer life, and she doesnt want to live with either of them. can she make that choice at her age now? her father claims if she chooses me he will take me to court on grounds of being a unstable home. which he has no grounds what so ever. what can i do? thank u for ur time appreciated.

You really must contact private counsel; the court which granted the divorce and ordered the care, custody and control of the children must be advised of where the children have resided and what is best for them now. While it is true in KS that children of age 14 MAY convey their wishes w/re to custody to the judge, the court will consider the total circumstances in order to determine what is in the best interest of the child. It is most difficult to do this on your own. . .I highly recommend that you contact legal counsel.
