I am currently in a comman law marrige in kansas. it has been for about a year now. I am wanting to get out of my marriage, I was married to the man before, and I got custodial custy of my daughter, this time my husband is asking to be the custodial parent and I am not wanting him to be. he was orderd in the past to pay child support for our daughter, i would like things to go back to our divorce before

There will be good and bad points to consider when alleging a common law marriage. If you desire the old divorce arrangements to control, it may be better to forego a common law marriage argument. See an experienced family law attorney.
