Legal Question in Family Law in Kansas
should I take him to court for not paying medical expensis
My ex-husband and I divorced when our daughter was an infant. The divorce papers say he is to obtain and maintain medical insurance and pay $117 a month in child support. Our daughter is now 4 years old and has had two surgeries and is in the emergency room alot. My ex-husband will not put her on his insurance or help me pay her medical bills. My new husband has her on his insurance which is good, but I have paid over $10,000 in medical bills just on my daughter.
I am trying to raise child support and we have a court date next week. But my mom wants me to cancel because she sayes he will try to get more custody.
I have a family member (not in the home) that was tried for sexual abuse and was only charged with a misdimener. Can he use that against me and get more custody or take my custody away?

You're probably not going to get an answer you wish from me. ..and I don't mean to scold you, mom. . .nothing I wouldn't tell dad: children need both a mother and father irregardless of who pays what. I know it is difficult to separate the two. . .however, the court will, as will your child as she matures (they're not dummies)! Read the headlines in any paper this day. . .children need the opportunity to establish a relationship with BOTH of their biological parents. That said. . .for heaven's sake, yes, advise the court that you need assistance w/medical bills as formerly ordered. You said the sexual offender does not live in the home of your child. . .does he have access? Think your mom assisted w/creating your problems...you follow YOUR instincts, girl. . .your daughter may benefit from whatever contact she may have w/father. . .don't you be the one she blames for not having access to him. GET TO COURT AND ADVISE THE COURT OF YOUR PROBLEMS. Good luck.
