Legal Question in Family Law in Kansas

My daughters father left when she was six months and I have heard that if the legal parent dies by Kansas law the child automatically goes to the other parent. Since he had never been around and was previously abusive when we were together can I write a will in order to prevent her from going into his custody?

Although it is not binding, it is a great idea to write a Last Will and Testament that nominates a Testamentary Guardian for your child in the event of your death. That lets the Court know your preferences, and the Court can take that into consideration if faced with a decision as to who should take care of your child or children. We are here to help.
