Legal Question in Family Law in Kansas

Disability and child support order

I was ordered to pay child support to my Ex husband for my two children and have been off on disability from work since March of last year. I have only been receiving half pay, but he has still been receiving the full payments until this past month. I am no longer being paid. I sent a request to the KS cse office but have not heard anything back. There is a great chance that I will be going off the payroll in March. What happens now and if I lose my job?

Re: Disability and child support order

You should notifiy the court which ordered the child support that there has been a significant change in your financial condition immediately by filing a "Motion to Modify Child Support". You must submit a child support worksheet, setting forth your earnings and those of your ex in order that the support amount may be recalculated. The court will anticipate that the minimal income available to you is minimum wage...no less. Good luck...do take action asap.
