Legal Question in Family Law in Kansas

Discovery and Interrogories

I just got ALOt- almost 150 pages of discory request in a civil paternity/visitation case. I do not have a trail- just a hearing on me seeing my daughter. What happens if I refuse to allow the discovery and do not turn in the items?

Re: Discovery and Interrogories

If the discovery requests are too burdensome, you can properly file an objection to them, but you may not just refuse to answer them.

After following court rules concerning discovery disputes, a hearing may be scheduled to settle the discovery issues.

If a party has wrongfully failed to comply with discovery requests, sanctions may be imposed by the court. Those vary according to what the court believes is fair, but the sanctions may include, an order to produce the discovery, an order precluding a party from disputing certain issues, and/or an award of attorney fees, among other things.

Consult an experienced family law attorney.

Note that the Kansas discovery rules require multiple sets of interrogatories to be served on you. You may not have gotten as many questions as you originally thought. Check for multiple copies.
