if i filed for divorce before my husband and he has tried to establish a residence in texas which state has precedence in the case

The one who files first wins unless the other party can prove there is a problem (such as not a resident the required period of time).

If all jurisdictional requirements are met, the first to file wins. However some issues, such as child custody jurisdiction, are governed by different rules. Consult an experienced family law attorney.
