Legal Question in Family Law in Kansas

divorce

Can I sell the things I bought during my marriage to a friend for a penny, making sure to get a receipt. Then buy it all back for two pennies after the divorce? I will give her half of what I make for selling the stuff.

No. Kansas is an "equitable property division" state. That means the judge has the ability to award either party ANY of the property of the parties in order to achieve fairness. (Even the other party's premarital property.) If you sold property, the judge could award your spouse any other assets, like your retirement account, etc., or grant your spouse a money judgment against you to balance the property division. If there were a dispute as to the value of the property sold, the aggrieved spouse likely would get the benefit of the doubt.
