Ex-husband attempting residenatial custoday under parens patria

My ex-husband is attempting to change the residential custody. He's trying to say that it is dangerous for her to live with me because my soon to be ex-husband was abusive to me. He's not visited her but twice in five years at my residence. He's not paid child support the whole five years maybe two or three. He can't have children and is not the natural father, but signed and agreement at birth. When my husband was battering me I took the child to his mother's. They are saying I dropped her off with out notice, and left her for no reason. But he was not there when she was in danger and now all the sudden wants her. What is it that I can do to prove she should stay with me. Would proving him not the father help, or only if the natural father were able to take responciblity. She was recently declared ''not a child in need of care''. Send me some good advice.
