False testimony in child custody hearing
My daughter and husband live in Tucson but had to go to Dodge City, KS, for a child custody hearing for her 7-year-old daughter and 4-year-old son, who for the past 2 years were splitting the year living with their father and my daughter equally. My granddaughter told her mother she does not like having to change schools in the middle of the year and wants to go to school in Tucson all year. My daughter and son-in-law provide a stable, loving home for my grandchildren. When they are with their dad, still single, they have an unstructured life, often being dropped off at his mother's house so he can go out at night partying. He has 2 brothers who have been involved with drugs and even smoked marijuana in his mother's home when the children were there, and his mother was aware of it. His father is hardly a role model to my grandchildren--long hair in a ponytail, tattoos, piercings, and my daughter believes still smokes pot himself. In court on Thursday, my daughter's ex brought in witnesses, and they all lied on the stand about the drug use. My daughter should have won custody, but the judge sided with her ex based on how many blood family members the children had with each parent! Would it be a losing battle to appeal?
