Legal Question in Family Law in Kansas

My fiance's divorce decree with his ex-wife states that each party shall be responsible for one-half of their tax debt from the year 2000. They owed $14,000 to the IRS, last year he filed all of his past tax years from 2001 to 2008 in an attempt to help pay down the debt. He payed the IRS a total of $11,554.00 of the $14,000 debt. Since the court papers say they are both to pay one-half of the debt, can he take her to small claims court to ask that she re-emburse him for the extra taxes he paid?

If they owed $14,000 in 2001, interest and penalties have probably nearly doubled that amount by now. If your husband paid more than half then he could sue his ex for contribution of the portion that was more than half.
