If I file for a legal separation from my husband can I remain on his health care policy with his consent? What are the benefits of a marital separation over a divorce? Thanks for your time.

Depending upon the insurer, you should be able to maintain your coverage. You may be treated with COBRA like rights, so you may have to pay the full premium for your individual coverage. But, if your husband consent to the continued coverage, the insurer may not even realize you are seperated. Your attorney can explain youroptions to you.
