Legal Question in Family Law in Kansas
My grandchildren were taken out of the home because someone made a false report that a knock down fight had occurred between the parents in front of the babies age 4 months and 18 months. There were no bruises no police reports and the parents both have stated though they did verbally fight that was the extent of it and the person who called did so because they told her she could no longer live there. They received a letter from the SRS person stating she found it unsubstantiated but they will not return the children or let my son see them and the mother only 30 minutes once a week. Their court appointed lawyers are not helping they do not answer phone calls or return calls. What can we do?

HIRE PRIVATE COUNSEL TO HELP THE PARENTS! Kansas Law, in this area, is getting fixed, but is still abnormal. If the kids remain in State custody for too long, they can be adopted out, despite how well the parents prove their fitness. Appointed counsel is great, But, these types of cases, (until the law gets fixed) require concerted, strong effort. You may not feel that you can afford to hire counsel. Look around your house and garage, and see if there is anything you'd rather do without, instead of your grandchildren. Then contact your state representative and Senate, and ask them to put some sanity into the laws regarding the ability of State agencies to keep children from their parents, after the investigation is over.
