Legal Question in Family Law in Kansas

My grandchildren's father was issued a bench warrant for failure to show in court for multiple traffic violations. Does my daughter, by law, have to allow the children visitation with their father with an outstanding arrest warrant???

I am afraid the children may be there when the arrest warrant is served.

I have yet to hear of a judget that will accept the fact that the other parent having outstanding traffic violations as an excuse to deny visitation. It would more likely be the basis for your daughter to lose custody, then it would be a viable defense agaisnt her being found in contempt for preventing ordered visitation.

Good luck
