Legal Question in Family Law in Kansas

Husband and I married 10 years. I've been raising his kids for 10 years but we are now separated. Do I have any legal claims to the kids if we get divorced? Can I file for custody or legal guardianship? The mother is missing in action and does not have a relationship with the kids. i obviously have a bond with them and was wondering what rights to I have being their only known mother? Thanks

You can request visitation in a divorce action. You yourself have very little "rights" to the children. But the children may have a "best interests" type right to a continued relationship with you. The Court will decide this, and it may be affected by their father's opinion as to continued exposure with you. If you indicate that you are willing to contribute financially to the children's care in the future, (although you probably cannot be ordered to pay child support to the father), the court may take that into consideration in deciding whether to order visitation.
