Legal Question in Family Law in Kansas

My husband has stated that he wants a divorce. I work part time evenings from 11pm to 3am Mom- Fri. we have one child together and we each have one from previous marriages. He is stating that unless I let him have custody of our child, he refuses to leave. He has been very abusive emotionally to me and our kids, what sort of legal ave. do I have to have him remved from the home until the courts can decide custody?

If your husband is very abusive, it may be better for everyone if you separate during the divorce. Custody of a child should always be based on the best interest of the child.
