Legal Question in Family Law in Kansas
I have Joint Custody of my 2 1/2 year old son. My ex and I both live in Kansas. Even though we have Joint Custody, I have him the majority of the time. She has expressed interest to move to North Carolina to be with her boyfriend that is stationed in the Army there. And she wants to take my son. What are the chances that the court would grant her request to take my son there?

We have considerable experience in defending child relocation cases. The court will base it's relocation decision on the best interest of the child. Many factors should be brought to the court's attention to show that it is in the child's best interest to keep the child in this area. If the child has been with you the "majority" of the time, you certainly have a chance for success in keeping the child here. The mother has a constitutional right to relocate, but that does not extend to the child. Consult an experienced family law attorney. We are here to help.
