my husband and i are not getting along and i want a divorce but havnt filed yet can he take our 2 young children out of state to stay at his moms house he hasnt filed yet either but came and got the kids

This is a very hazardous legal situation for you. Child custody jurisdiction is normally determined by where the children have lived for the past six months; but if a change of residence happens when divorce is contemplated, a parent's motives must be examined. Consult an experienced family law attorney.
