My boyfreind and his soon to be ex wife have been living in separate states for 6 months now and are gonna be divorcing. Does this current situation constititute legal separation

No. A legal separation, sometimes called "separate maintenance," is a specific legal action like divorce. It normally covers all of the same issues such as division of property and child custody, but after a Decree of Separate Maintenance is awarded, the parties are still married.
