How long does a married couple have to be separated before its considered to be a legal separation?

Being physically separated is not the same as being legally separated. A legal separation (also called a Separate Maintenance action under Kansas law) is a court proceeding. It involves most of the same elements of a divorce, in that property and debts are divided, and spousal maintenance can be ordered. Child-related issues are also resolved. A legal separation is often requested when one or both of the spouses prefers not to get a divorce for moral or religious reasons. Consult an experienced family law attorney. We are here to help.
