Legal Question in Family Law in Kansas

I am married and we have a son together. Do I have to file for seperation and custody before I can I move back to Texas with my son?

Generally married parents can take their kids anywhere in the US without a Court Order. So, unless there are other facts that you didn't share, you need not abandon your wedding vows to move to Texas.
