Legal Question in Family Law in Kansas

Can i modify cusotdy?

My ex-husband and I have shared custody of my 3-year old daughter. She spends half the week with me and half the week with him. However my ex is bipolar and is going through a manic period right now. He lives with his mom and brother, he isn't working and doesn't even have a car. I asked to keep her during the week and would allow her to stay saturday evening through sunday night because her grandmother is there to supervise but they seem to have a problem with this. I am looking out for my daughter and her well being. Should i pursue this legally? I am on a limited income and i don't want to start something if i don't have a good enough reason according to the law to change our custody agreement. I would like to gain full custody because i don't think my ex and his mom see how her mental well being could be affected by his mania. I would like him to only have supervised visits, would this be something a judge would allow or am i hoping for too much?

Re: Can i modify cusotdy?

It is not appropriate for any lawyer to attempt to predict the outcome of a child custody hearing based on limited information. Certainly, if the father is having mental problems that affect his ability to care for the child, something should be done.
