Legal Question in Family Law in Kansas

Move Out

My wife is violent and tried to kill me. She participated in a diversion program for a Level 7 felony domestic violence charge. I have filed for a divorce, one year after the diversion program ended. She is requesting that I move out of the house in response to my temporary order. I have not perpurtrated any violence towrad her, etc. How is the judge likley to rule. In my petition for divorce I asked that we both live in the marital home, as we have 9 full baths and I run a business from our home.

Re: Move Out

It appears that the Temporary Orders in this matter were not sufficient to deal with this situation. You should consult an experienced family law attorney to discuss new Temporary Orders. If you run a business from the home, that is a strong factor in your favor when deciding who should move out.
