Legal Question in Family Law in Kansas

moving

Currently my ex and children live 30 minutes from me (share custody, her the res. custodian). I was notified recently by phone that she was moving the kids another hour away, so it will be one and a half hours one way for me to pick my kids up on the weekends, total of 3 hours drive. Can she do this w/o a modification in child support, or can I request we meet half way. I am ready to fight her on this matter.

Re: moving

Under Kansas law, notification of relocation of a child's residence must be done by restricted mail, with return receipt requested. If your divorce was granted in Johnson County as your zip code suggests, you should request mediation to discuss the relocation and transportation issues. A change in child support may be warranted, depending on the actual increase in travel expenses. If transportation is shared equally, it is much les likely that child support will be affected. Consult an experienced family law attorney.
