Legal Question in Family Law in Kansas
non-compliance with support orders/visitation
My ex has orders to pay childsupport, medical and dental. It is only a childsupport order; through a state agency who took it to court. There is not a set visitation order. My question is; since the father has never provided medical and/or dental insurance for my child in the 3 years of the order, and he has only paid less than one monthly payment of child support in the last 13 months. He didn't bother to call for six months and now for the last three months he only calls once a month. He asked to have her for a weekend and then never called or showed. What can I do? Can I deny him the right to even see her or would I be in contempt? I have tried to deal with this certain state agency but I only get the run around.

Re: non-compliance with support orders/visitation
It would be best for you to consult an attorney with regard to the visitation issue. If there is not an order for visitation, you would most likely not be in contempt for not allowing him to see your child since there is no order in place for you to follow. If he wants to have an order established for visitation, he would need to file a motion with the court. However, it may not be as simple as that and for more accurate information regarding your specific situation, it would be a good idea to consult an attorney.
