Legal Question in Family Law in Kansas

My ex was ordered to pay child support in 2006 and has never paid. He does not currently live in the county where the court orders were made. Since then my son has desired to spend more time with his father's side of family and now my ex is getting physical custody. What about the 5 years I was the sole contributor to financial care of my son? Am I entitled to file for any back child support now? Does he still owe it? Please help, thanks.

If the 2006 Order of support wa wsvaild, then he owes the back support. You may sue to get it, even if he has moved from the County or even the state. You may have to bring the suit in the county where he lives, though. But, if custody is switched, then you may owe support to husband in the future. It is uncertain how each court will treat giving husband credit for each month he has custody now, to lessen his burden for past due support to other parent. If you let me know what parts of the state you and Dad live, I may be able to refer you to someone to help.

Good luck
