Re: parantal abandonment
Its not really a matter of time, but rather facts.
There are two steps:
1. The biological husband has to be deemed "unfit", and then
2. the court has to decide that its in the child's best interest to be adopted by the step father. The first step seems pretty good for your position, since one of the grounds is "Failure To Maintain a Reasonable Degree of Interest, Concern, or Responsibility" that would apply here. The second step is very easy, and will apply to your situation.
I actually handled something similar to this not too long ago, where the stepmother wanted to adopt a child and was married to the biological father. If you have further questions, or would like to start such a process, please call my office or email me. Good Luck!
Re: parantal abandonment
Can only be done with agreement of the father.
