Changes to the Parenting Plan
My fiance has four children with his ex. They reside in Kansas, we reside in Florida. He is paying her child support and maintenance through payroll deduction. The existing parenting plan states that the exchange point for visitation is her home and that he pays for 100% of the travel. He wanted them for the summer, however she stated that he would need to pay for all of the travel (per the agreement) and continue to pay the support. Obviously, that is financially impossible. Current attorney on the case has not returned any phone calls regarding options for resolving this. My fiance would like to get the parenting plan significantly altered (possibly to include getting physical custody of the kids since she allowed the family home to be foreclosed and is living in the projects) so that the financial burden is more evenly distributed and he is able to get them here. Does he need to find another attorney in Kansas, or can one here in FL help him? What process must take place to get the changes at least heard by a judge? Thanks
