Legal Question in Family Law in Kansas
Passport revoked
My passport was revoked while I was working overseas because I was behind $18,000.00 in child support. This was a result of me finding out that I had a child whom I had no idea existed until she was 4 yrs old. I have paid the debt down to under $8,000.00. Is there anyway that I can apply for a wavier so that I can be issued a new passport so that I can return overseas to continue working?

Re: Passport revoked
The first thing you will have to do is pay down the arrearage under $5,000.00. As you will see below, federal law provides for revocation of passports for child support arrearages of $5,000.00 or more. Then you will have to make a request through the child support jurisdiction in order to have the limitation on your passport withdrawn. Consult an experienced family law attorney in your jurisdiction.
United States Code provision:
(k) Denial of passports for nonpayment of child support:
(1) If the Secretary receives a certification by a State agency in accordance with the requirements of section 654 (31) of this title that an individual owes arrearages of child support in an amount exceeding $5,000, the Secretary shall transmit such certification to the Secretary of State for action (with respect to denial, revocation, or limitation of passports) pursuant to paragraph (2).
(2) The Secretary of State shall, upon certification by the Secretary transmitted under paragraph (1), refuse to issue a passport to such individual, and may revoke, restrict, or limit a passport issued previously to such individual.
(3) The Secretary and the Secretary of State shall not be liable to an individual for any action with respect to a certification by a State agency under this section.
