Should he have to pay?

Okay my boyfriend and I have been together for 3 years, two and a half of which we have lived together... we recently moved into an apartment, and I found him cheating (again) less than one month later.. now I have 12 months of my lease left in an apartment I cannot afford on my own. my question is because he is also on the lease and we have technicaly established a common law marriage, could he be held accountable for the part of the rent he is currently paying? (almost like alamony?)

The length of time together does not necessarily make a common law marriage.
