Legal Question in Family Law in Kansas

Paying Child Support

My divorce decree says I pay child support during the minority of the children or until June 1 of the school year during which the children become 18 years of age, if the children are still attending high school, or until further ordered by this court. These are twins that will be 18 in a year in a half. There mother has told them they're out of there (live in Okla) when 18. They turn 18 and start senior year of high school that fall. So I know I have to pay child support till June the following year which is fine. They and I want to know if one or both move out when they become 18, do I still have to pay her the child support since she won't be supporting them any more or pay it to them there senior year till schools out? I assume if only one moves out then I would pay my ex wife half the support and give the other girl her support? Would this be right? Thank you.

Re: Paying Child Support

Child support and custody of minor children is always subject to modification on the basis of "change of circumstances". If your children are moving into your home prior to their last year in HS, you need to Petition the court of ORIGINAL JURISDICTION to set up that modification. . .just don't stop paying child support, 'cause the State will not know that w/o a court order modifying your obligation. If ex agrees they're moving in w/you, get a signed, notorized statement of the arrangement, whereby she foregoes child support, submit the same for court consideration and an order terminating your obligation to mom.
