Is the primary parent spossed to keep insuranse on the children?

My ex and i have joint custody of the 2 children of the marriage.

He has resadental custody and had Insuranc when we divorced. No order was made for Insurance. The child support work sheet he made stated he had Health insurance for both children but now his girlfrind has told me that they have no Health insurance for the children. What are the Laws on that subject?

In Kansas, the primary residential custodian does NOT always carry health insurance on the children. The question should be who can obtain the best coverage at the best cost. The responsibility for maintaining health insurance should be spelled out in the Separation Agreement or Divorce Decree. Child support will be calculated based on that stated situation. It is the Court Order, not the Child Support Worksheet, that controls. If the responsible party does not maintain health coverage for the children, the other party should see a lawyer about changing the court order and re-calculating child support. Any delay could expose the parties to potentially disastrous liability for medical expenses.
