Legal Question in Family Law in Kansas
Responsible Parties of Medical Bills
My ex-wife takes my children to the doctor or dentist and tells them to bill my insurance and make me the responsible party. The bill is sent to her address and she doesn't tell me about the bill. When it is not paid, it goes against my credit report. How is she able to make me the responsible party when I don't even know my children are seeking medical care? Shouldn't she be the responsible party?

Thank you for posting your legal question on LawGuru.com. My name is Alexandra White and I am an associate with The Harris Law Firm.
The answer to your question depends upon the language in your Separation Agreement or Support Order. If there is no language in your order allocating uninsured medical expenses between you and your ex-wife, you might not be able to do anything to fix what has been done in the past. I am presuming from your question that your court order is either vague or does not contain any provisions for the sharing of these expenses. If so, you need to ask for an Order that allocates these expenses between you and sets up a system that will protect you. Unfortunately, you may not be able to repair the harm to your credit to this point. However, I would need to review your current orders in order to provide you with specific advice as to your options.
I would be happy to meet with you in person. Our firm offers a 45 minute consultation for a flat fee of $150.00. Please feel free to contact us directly at (303) 299-9484 if you are interested in setting up an appointment to discuss your options. Again, thank you for posting your legal question to LawGuru.com.
