seperation with a child

ok in the state of kansas is when two people seperate and they have a child.isnt the child a ward of the state until the two people go to court my son and his xgirlfriend both signed a paper saying he would have his child so many days and she would have him so many days.well she got mad at the father and now she wont let him see their son till they go to court isnt that paper a binding agreement between them both and she cant take him away from his father.and i need to kno grandparent rights.

No, the child is not a ward of the state when parents separate. If the parents have voluntarily signed a Parenting Plan, the court will consider it. It is not enforceable until the court adopts it as part of a court Order.
