Legal Question in Family Law in Kansas

my sister in law pasted away this morning and have a 3 yr old daughter and does not have a will, my question is who can take the baby?

The child's father. If the child's father is unavailable or unsuitable, then someone (preferably a family memeber) will need to file a guardianship action and request to become the child's legal guardian
