Legal Question in Family Law in Kansas

i want to take my son on vacation for a couple months to NM to visit family members. the mother has had a grand total of 30 minutes of visitation in the last 4 months now. we are still legally married, but have been separated for almost a year now. can the mother get me for kidnapping as long as i give her the information and tell her where i'm going and when i'll be back?

If you give 60 days notice and she doe snto object, you wil lnot likley be accused of kidnapping for taking the kids while on vacation. If she contests it, you might have to litigate. If she does not, but you fear that she might make false claim while you are on vacation, you might send letter to the county prosecutor's office prior to leaving, letting them know where and how you can be contacted in NM. You might also give this information to your neighbors. That way if the cops are called, they will quickly get that information when they start investigating, and you can avoid an Amber alert type situation.
