Legal Question in Family Law in Kansas

Splitting up amicably.

Hello, my name is Andy and I have two children, a four year old and a two year old. Say I wanted to take my wife and two kids to Texas to live with her parents. I come back to Kansas and cut off ties here for a year (I own my business and have stuff of my own that I need to move). Would I have to send any money for that period of time for child support to avoid a child support order? We don't intend to get a divorce and would like to get back together in time. Also, what if she applies for state assistance and I am not there yet? Would that be grounds for an automatic child support order sent to me since I am not in the household? What would prevent such an order in the first place?

Re: Splitting up amicably.

The title to your question, "Splitting up amicably," is very much in contrast to the actual situation you describe. The facts you describe are too complex to predict every legal possibility, but you have made one thing clear from your statrements about "cutting off ties" and state assistance being involved: You don't intend to provide support. If no support is provided, your wife will likely file for state aid or file for a divorce. That will likely trigger support orders. The way to prevent such an order is to provide satisfactory spousal maintenance and child support no matter where the parties live.
