Spouse requests Husband to leave the Family Home

What, if any are the implications of leaving the family home if asked by the spouse to do so. Will doing so set any kind of precedent for stipulations of a settlement if a legal separation or divorce then occurs?

When a new divorce or legal separation case is filed, the filing party often requests that Temporary Orders be granted. The judge will consider the current status/living arrangement of the parties when evaluating the Temporary Order request. If one spouse has moved out, that may affect his or her rights during the pendency of the case. That could include issues of residential child custody and temporary possession of the residence and contents. Consult an experienced family law attorney.
