Legal Question in Family Law in Kansas

SRS custody pending

If there is a court case already in court, to decide whether

children should be put into SRS custody, but the case has

not seen it's court date yet, would it be legal, or helpful,

to sign children over to a relative, before the court makes it's decision? If the children are signed over, does it

stop any court intervention, or can the court still put the kids into SRS costudy?

Re: SRS custody pending

The purpose of the Child in Need of Care Case is to determine what, if anything, is happening to a child(ren) that is inappropriate concerning the care, custody and control over the child. No, it will not stop the action to place the child elsewhere. . .address the problem, if there is one. The obligation of SRS is to do all it can to reintegrate the child back into parental custody, unless by doing so, the child is endangered. Look at the problem. . .the reason the case was filed and attempt to resolve that.
