Legal Question in Family Law in Kansas

step parent adoption

My 13 year old daughter would like to have my husband adopt her. Her father resides in Iowa, but we have lived in Kansas now going on 4 years. I have recently found out that she was assaulted by one if her fathers family members and have contacted the sheriff and a councelor for my daughter. I want to know if this would be considered enough reason to terminate his parental rights so that my husband can adopt her? My husband and I have been married 1 1/2 years but have been together for 5 and he is the most stable father figure she has in her life right now. She doesn't want to go see her father because he tells her that he can't stop the person that assaulted her from coming over to his house while she is there and that she should just learn to forget it. We don't have any custody or visitation papers, but we do have a child support paper that is through the Iowa court system. Any advice on this would help me greatly in knowing how to get started.
