Step-son name change

Me and my wife are both military soldiers stationed in kansas we are expecting a boy but my wife has another son from a previous marriage. He was born out of wedlock and paternity has not been established. We are wanting to change his last name to mine to prevent confussiong to both boys will growing up. The biological father is not actively involved as far as he knows i am his father. The biological father sends 300 a month for support. can we change our sons last name without his consent? and if so do we change his name were we reside now or where he was born?

The minor child's name may not be changed without the father's consent.
