Legal Question in Family Law in Kansas
sue former spouse for fraud
Is it possible to sue a former spouse for fraud?
Misrepresentation of herself for financial gains, pregnancy and now excellent manipulation of the laws , courts.
I'd like to be able to get my family name back from her. Is it possible to force her to return it?
I have two sons with this person.

Re: sue former spouse for fraud
It is possible to sue for fraud in Kansas however it is the most difficult cause of action to sustain and most judges, if not all, in Kansas would not go for such a cause of action against a former spouse because they would view it as merely "bad feelings" and "revenge." I suppose you may be able to recover it is meant that you lost thousands of dollars, i.e. your spouse misrepresented or hid hundreds of thousands of dollars, i.e. lottery winnings or offshore bank accounts.
As for getting your name back! Well, only the spouse with the name can change the name and this means that if a spouse has taken a name and then later divorces then that spouse can keep the name or change it as they see fit. The courts will never "make" a person change their name at the request of another.
Sincerely,

I totally agree w/the initial response given by counsel herein; you didn't mention how long ago the divorce occurred, however, it would appear that you have chosen to overlook the mental and emotional damage you may be causing your 2 sons by continuing what apparently has become a vindetta between you and their mother. Obviously you and she decided to sever your relationship. . .get on with your life. . .she remains the mother of your sons. . .by berating her, you also berate them! Life for the youth these days is difficult enuf without having to deal w/an irrational parent as well.
