termination of rights

my ex-husband has told me that he wants to give up his rights to our 2 yr old daughter if me and my present partner get married. he hasnt paid any child support since he's ben ordered to in 09/05. if me and my partner do decide to get married can he legally adopt my daughter. i have reason to believe that my ex husband rather give up his rights so he would not have to pay child support any more due to the fact he just had another child with someone else. if you could help me with this please it would be greatly appreciated.
