Legal Question in Family Law in Kansas

Unemployed exspouse

My husbands ex has been unemployed for atleast the last 4 years, when it comes to figuring out child support my husbands overtime and raises are included in his side and her income has not been raised at all. Her new husband is well off and she does not have to work, is there something we can do to get some offset since she will not work?

Re: Unemployed exspouse

A lot depends on what her past work history is and whether she has any formal education. You need to make sure they are at least imputing minimum wage to her on the child support. As to the overtime and additional pay of your husband, if he has a history of receiving this, it can be considered by the court as normal income. You can not use any of her new husband's income in figuring child support.
