Legal Question in Family Law in Kansas
My wife asked for divorce. She is asking for almost $3,000 a month in maintenance. We have been married for two years and have no children. Payments to her are to start on December 1st, but I do not have the money and I could not hire an attorney in a timely manner because it coincided with the holidays. I would like to know what are my options? Could I get the payments postponed until I hire an attorney? What would happen if I just don't pay and hire an attorney by the 2nd or 3rd of December, then file a motion not agreeing with what she's asking for? Could I go to court myself on Monday (before the 1st) and file a motion or something myself?

What she filled was a Petition. It isn't a Judgment yet. But, the Judge may order temporary maintenance. It will be based on your relative earnings. You can denybthe allegations of her Petition and tell the Judge that you will have funds to hire an attorney in a few days, or you want your wife to pay for your attorney. You will need to have a written answer on file. So, it us important that you get an attorney very quickly, regardless if who is paying. Try to hire one before the hearing.
